Please read these Terms of Service (“Terms”) carefully before using the East Electra website or placing an order. By accessing our site or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our site.

1. About Us

East Electra (“we,” “our,” or “us”) is an online jewelry and accessories retailer operating at www.eastelectra.com. We sell and ship products worldwide.

2. Eligibility

You must be at least 16 years of age to use our site or place an order. By using our site, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

If you are placing an order on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Products

East Electra sells jewelry and accessories. We make reasonable efforts to display product colours, materials, and dimensions as accurately as possible. However, we cannot guarantee that your device’s display will render colours or textures exactly as they appear in person.

Product descriptions, images, and pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

We do not warrant that product descriptions or other content on our site are accurate, complete, or error-free.

4. Orders and Payment

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order is not confirmed until you receive an order confirmation email from us.

We may cancel or refuse an order if: a product is out of stock or discontinued; a pricing or product description error has occurred; we are unable to verify payment; or we suspect fraudulent activity.

Payment Processing

All payments are processed securely through Stripe, Inc. We accept major credit and debit cards as made available through Stripe at the time of checkout. By completing a purchase, you also agree to Stripe’s Terms of Service.

We do not store your full payment card details on our servers. All payment data is handled directly by Stripe in accordance with PCI DSS standards.

By providing payment information, you represent that you are authorized to use the payment method and that the billing information you provide is accurate.

Order Cancellation

Once an order has been placed and payment processed, we cannot guarantee cancellation. If you wish to cancel an order, contact us immediately at hello@eastelectra.com. We will make reasonable efforts to accommodate cancellation requests received before an order has been fulfilled or shipped, but cannot guarantee this.

5. Pricing and Taxes

All prices are listed in Canadian dollars (CAD) unless otherwise stated. East Electra reserves the right to change prices at any time. The price charged for an order will be the price displayed at the time the order was placed.

Customers are responsible for all applicable taxes, duties, and customs fees associated with their order. For orders shipped outside of Canada, the recipient is responsible for any import duties, customs taxes, or brokerage fees imposed by their country. East Electra is not responsible for delays caused by customs processing.

6. Shipping and Delivery

We ship worldwide. Estimated delivery times are provided at checkout and are estimates only — they are not guarantees. Actual delivery times may vary due to carrier delays, customs processing, weather, or other factors beyond our control.

Risk of loss and title for products pass to you upon our delivery of the order to the carrier. East Electra is not responsible for lost, stolen, or delayed packages once they have been handed to the carrier. If your order is lost in transit, please contact us and we will assist you in filing a claim with the carrier where possible.

Shipping addresses must be accurate and complete. East Electra is not responsible for orders delivered to an incorrect address provided by the customer.

7. All Sales Final — No Returns or Refunds

All sales are final. We do not accept returns, and we do not offer refunds or exchanges, except as described in Section 8 (Damaged or Incorrect Orders) or as required by applicable law.

By completing a purchase, you acknowledge and agree to this policy. We encourage you to review product descriptions, images, and sizing information carefully before placing an order. If you have questions about a product prior to purchase, please contact us at hello@eastelectra.com.

Nothing in this section limits any rights you may have under applicable consumer protection legislation that cannot be waived by contract.

8. Damaged or Incorrect Orders

If you receive a product that is damaged in transit or materially different from what you ordered, please contact us at hello@eastelectra.com within 7 days of delivery. Include your order number and photographs of the damage or discrepancy.

We will assess each case individually and, at our sole discretion, may offer a replacement, store credit, or refund where appropriate. We are not obligated to provide a remedy for damage caused after delivery or for minor variations in colour or finish that are inherent to handcrafted or artisan products.

9. Accounts

You may be able to create an account on our site. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

We reserve the right to terminate or suspend accounts at our discretion, including for violation of these Terms.

You may request deletion of your account at any time by contacting us. Account deletion is subject to our data retention obligations as described in our Privacy Policy.

10. Intellectual Property

All content on the East Electra website — including but not limited to text, product descriptions, photographs, graphics, logos, and design — is the property of East Electra or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on our site without our express written permission. Personal, non-commercial use of our site content is permitted solely for browsing and placing orders.

11. Prohibited Conduct

When using our site, you agree not to:

  • Use the site for any unlawful purpose or in violation of any applicable laws or regulations
  • Engage in fraudulent activity, including placing orders with stolen payment credentials
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Scrape, crawl, or harvest data from our site without our written permission
  • Transmit spam, viruses, or any harmful or disruptive code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Post or transmit content that is defamatory, offensive, or infringes the rights of others

We reserve the right to terminate access for any user who violates these prohibitions.

12. Disclaimer of Warranties

Our site and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, East Electra disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the site or the servers that make it available are free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by applicable law, East Electra and its owners, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our site or products, including but not limited to loss of profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of our site or your purchase of products shall not exceed the amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless East Electra and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our site, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of our site shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached informally, disputes shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

If you are a consumer located in a jurisdiction with mandatory local consumer protection laws, nothing in this section limits your right to bring a claim under those laws.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of our site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

For material changes, we will make reasonable efforts to notify you via email or a prominent notice on our website.
